Client was operating his vehicle westbound on 106th Street and as he attempted to turn left onto Towne Road with a green turn arrow, Defendant, who was traveling eastbound on 106th Street, disregarded the red traffic signal and collided with client’s vehicle. According to the police report, the Defendant was not paying attention and did not see what color the traffic light was. After client died from unrelated causes and was unable to testify, Defendant later changed Defendant’s position. We were able to discredit Defendant after obtaining the Police Department’s on-scene audio wherein the Defendant stated she was “not paying attention and did not know what color the light was.” Client suffered life threatening injuries with prolonged hospital stay.
